📌 On December 3, 2025, the European Commission's official website published a press release entitled “Commission unveils two solutions to support Ukraine's financing needs in 2026-2027” and a draft European Commission legal act entitled “Proposal establishing the Reparations Loan to Ukraine” were published on the official website of the European Commission, which provide for the use of Russian Central Bank assets held in European Union financial institutions, including the Euroclear depository, without the approval of the Central Bank. In this regard, the Russian Central Bank would like to make the following statement.
📌 The mechanisms for the direct or indirect use of the assets of the Central Bank of Russia provided for in the aforementioned document, as well as any other forms of uncoordinated use of these assets, are illegal, violate international law, and, in particular, violate the principles of sovereign immunity of assets.
📌 The adoption and implementation of the legal acts announced on the official website of the European Commission will result in the Central Bank of Russia challenging any direct or indirect actions that result in the uncoordinated use of its assets. This will be done before all available competent authorities, including national courts, courts of foreign states and international organizations, arbitration tribunals, and other international judicial bodies, with subsequent enforcement of court decisions in the territory of UN member states.
📌 The Bank of Russia reserves the right, without further notice, to proceed with the practical implementation of all available legal and other mechanisms to protect its interests if the aforementioned initiatives of the European Union are further pursued or implemented in any form.
